On November 5, 2024, Missouri voters will consider Amendment 3, making Missouri one of 10 states with a certified abortion-related measure on their general election ballot. The amendment presents voters with a clear choice regarding reproductive rights in the state.

A “yes” vote on Amendment 3 would overturn Missouri’s current abortion ban, establishing fundamental rights for individuals to make and carry out their own reproductive healthcare decisions, including choices about abortion and contraceptives. Under the proposed amendment, government interference in these decisions would be invalid. The measure would prohibit discrimination in federal programs or funding against both medical professionals providing reproductive healthcare and individuals seeking these services.

If passed, abortion would only be restricted after fetal viability (when a fetus can survive outside the womb), with exceptions to protect the life or health of the mother. The official ballot notes that this amendment may reduce local tax revenue, though its impact on state tax revenue remains uncertain.

A “no” vote would maintain Missouri’s current abortion regulations under the ‘Right to Life of the Unborn Child Act.’ This act prohibits all abortions after conception except in medical emergencies.

Under current law, performing an abortion is classified as a class B felony, and medical professionals risk suspension or revocation of their professional licenses. The existing law also maintains several restrictions: a mandatory 72-hour waiting period, required counseling before procedures, parental consent for minors, and prohibitions on using Missouri Medicaid or private health insurance for abortion services, with limited exceptions.
