ST. LOUIS COUNTY, Mo. – A mother has filed a lawsuit against the Hazelwood School District, claiming that poor supervision led to her son being “pushed down” on the playground and severely injured.

Kelly Martin filed the lawsuit Monday through St. Louis County Circuit Court, more than two years after the incident at the center of the legal battle.

According to court documents obtained by FOX 2, the boy was injured on April 4, 2023 when he was “pushed down” on the playground by another student. The lawsuit claims the school’s staff was negligent and failed to properly supervise the children prior to the incident.

The lawsuit states that the boy suffered damage to the gluteal cleft in his lower back. It adds that he was treated for injuries at Washington University and Mercy hospitals with medical expenses costing around $2,600.

Martin told FOX 2’s news partners at the St. Louis Post Dispatch that her son was “drop-kicked” on the playground and also suffered a broken arm and concussion, though those details weren’t expressly included in the lawsuit.

The lawsuit seeks a judgement less than $25,000 to cover medical expenses, in addition to any other relief the court deems necessary.

FOX 2 reached out to the Hazelwood School District for comment. Our requests for comment have not been returned as of this story’s publication.
