ST. CHARLES COUNTY, Mo. – After three months behind bars on a $500,000 cash-only bond, Selena Rodriguez could soon get out. 

She is one of six people charged with murder after her 49-day-old baby died due to meth and fentanyl exposure in Troy, Missouri, last year. 

Rodriguez did not live with the child’s father. At a motion hearing on Tuesday, her attorney argued the baby was with the father at his home when the death occurred. 

“My client has no experience with or exposure to drug use at all,” said Matt Mueller, attorney for Selena Rodriguez. 

Mueller asked the judge for a $25,000 surety bond. He said that Rodriguez has no prior criminal history, has strong family ties in the area, including two other children and she has had no exposure to drugs in her entire life. 

Addressing concerns over flight risk, Rodriguez’s mom told the judge that she would tie her in a car and bring her to court if she had to. The judge agreed to lower the bond to a $100,000 surety bond. 

Special prosecutor for LincolnCounty, Dulany Harms, was satisfied with the ruling. 

“He has enough experience that he made the right decision; (he) made it reasonable for the defendant but also enough to ensure that the defendant will appear at her future court proceedings,” he said. 

In another motion, Mueller also asked for a child abuse charge to be dropped, arguing that “she was not present in the home and really had no connection to the home unlike the five other co-defendants,” Mueller said. 

But Harms argued that the charge is fair, and Rodriguez admitted to knowing the child’s father and others in the house were using fentanyl. 

“The statute is very clear that she put that child in harm’s way, putting it into a known drug house where there were drug activities, specifically fentanyl,” he said. 

The judge let the child abuse charge stand… but said the prosecution needs to amend its wording to identify a specific subsection of the law. 

During the motion hearing, both parties agreed to move the case to St. Charles County.
