LINCOLN COUNTY, Mo. – A teenage driver convicted of killing three teens in a Lincoln County car wreck in February 2023 is back in court after serving 120 days of shock jail time. Judge Michael Fagras called it “justice with tempered mercy.”

“It’s hard. You’re trying to still grieve the loss of these people and see justice done but every time you turn around, there is no justice being done,” Courtney Capizzi, Emily McNees’ aunt, said at the time. “She’s getting off pretty easy for what she did.”

Families of 15-year-old Kaeden Tyler, 17-year-old Emily McNees, and 18-year-old William Flickinger waited to see Zenk back in the courtroom after her sentencing in June for killing their loved ones. Zenk was sentenced to 120 days of shock jail time. Two months after her release, court records show an arrest warrant for Zenk for violating her probation by tampering with her alcohol monitor.

“There was another tampering event that lasted approximately 24 hours. So, both of those instances were quite problematic for the state,” Lincoln County Prosecuting Attorney Mike Wood said.

Wood said Zenk turned herself in last week and said his office is still investigating the tampering.

“The problem we have is that the alcohol that was detected was during a tamper,” he said. “So, then the question we have to ask ourselves is whether that was intentional or not.”

Wood said one of the tampering events lasted six hours and the other 24 hours, which is why he’s asking for Zenk to be held without bond. It’ll be up to a judge if Zenk serves additional jail time.

“She was given mercy back in June and she has violated that mercy and because of that, I think that she should be held accountable,” Douglas Meyer, Kaeden’s stepfather, said.

Zenk is set to be back in the courtroom on Thursday for a bond reduction hearing. FOX 2 reached out to her defense attorney, but they declined comment on the case.
